1. Agreement
These Terms and Conditions (the “Terms”) are an agreement between you
(“you,” “your,” or “User”) and DNCSweeper (“we,” “us,” or “our”)
regarding use of dncsweeper.com and related products, including list scrubbing,
exports, the Check API, webhooks, and optional CRM import features (collectively, the “Service”).
“User” includes both free and paying customers. By accessing or using the Service,
you represent that you are the end user of the Service (or are authorized to bind the
organization that is), and that you will follow these Terms and our
Privacy Policy.
2. The service
DNCSweeper helps outbound teams check phone numbers against Do Not Call data,
review and export results, and connect dialers or CRMs through API and webhook workflows.
The Service is a compliance support tool — it does not replace your own legal obligations
under telemarketing, TCPA, state DNC, or other applicable laws.
You are solely responsible for how you use scrub results in calling, texting, or other outreach,
and for obtaining any consents or exemptions required for your campaigns.
3. Accounts
You must provide accurate account information and keep your login credentials secure.
You are responsible for activity that occurs under your account, including API key use.
Notify us promptly if you suspect unauthorized access.
We may suspend or terminate accounts that violate these Terms, present a security risk,
or are used in a way that could harm the Service or other users.
4. Acceptable use
You agree not to:
- Use the Service for unlawful purposes or in violation of telemarketing or privacy laws
- Attempt to scrape, overload, reverse engineer, or disrupt the Service
- Share account credentials or API keys in a way that enables unauthorized use
- Upload data you do not have the right to process
- Misrepresent DNCSweeper results as a legal opinion or guaranteed compliance safe harbor
5. Reliability of data and service
The Service and any data, results, or outputs provided through it are offered on an
“AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law,
we make no warranty — express or implied — regarding the accuracy, completeness,
reliability, timeliness, or fitness for a particular purpose of the Service or DNC data.
You acknowledge that registry data can change, lookups may be cached briefly for performance,
and results may be incomplete or incorrect for reasons outside our control.
You use all data and outputs at your sole risk.
Except where prohibited by law, you agree that you will have no legal or financial claim
against DNCSweeper, its owners, officers, employees, or data providers arising from
defective, missing, incomplete, delayed, or otherwise inaccurate data or service results.
6. Availability
From time to time the Service may be unavailable due to maintenance, updates,
infrastructure issues, third-party outages, or other causes. You acknowledge that
interruptions can occur and that, to the fullest extent permitted by law, you will have
no claim against DNCSweeper or its service providers solely because of downtime or degraded performance.
7. Plans & billing
Paid features require an active subscription or plan as described on our pricing pages
or in your account. Fees are processed by our payment provider. Unless otherwise stated,
charges are non-refundable except where required by law or expressly offered by us.
Plan limits (such as scrub or API quotas) apply to your account. We may enforce those limits,
and overages or upgrades may be required to continue certain usage.
Failure to pay may result in suspension of paid features.
8. API & integrations
If you use the Check API, webhooks, or CRM import features, you must keep credentials confidential,
respect rate limits, and use endpoints only as documented. You are responsible for the security
of systems that store your API keys and for the destinations you configure for webhooks or imports.
Third-party platforms you connect (for example a CRM) are governed by their own terms.
We are not responsible for those platforms’ availability, data handling, or errors.
9. Confidentiality of account data
We treat account information you provide as confidential and handle it in accordance with our
Privacy Policy.
Technical and usage data — such as IP address, request logs, and product analytics —
may be collected to operate the Service, improve the experience, and detect abuse or fraud.
10. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless DNCSweeper
and its owners, officers, employees, and third-party data providers from and against claims,
losses, costs, damages, and expenses (including reasonable attorneys’ fees) arising out of
or related to: (a) your use of the Service; (b) your calling, messaging, or other outreach
based on Service results; (c) data you upload or submit; (d) your violation of these Terms
or applicable law; or (e) claims by your clients, employees, or the subjects of your lists
or investigations.
11. Limitation of liability
To the fullest extent permitted by law, DNCSweeper and its providers will not be liable for
any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any
loss of profits, revenue, data, or goodwill, arising from or related to the Service —
whether based in contract, tort, or otherwise, even if advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for any claim relating to the Service
will not exceed the amounts you paid to us for the Service in the twelve (12) months
before the claim arose.
12. Governing law
These Terms, and any dispute arising out of or relating to them or the Service,
shall be governed by and construed in accordance with the laws of the State of California,
without regard to conflict-of-law principles.
13. Changes
We may update these Terms from time to time. When we do, we will post the revised Terms
on this page and update the “Last updated” date. Material changes may also be
communicated by email or in-product notice. Continued use of the Service after changes
become effective constitutes acceptance of the updated Terms.
